Legal hermeneutics: Tool for the interpretation of factual elements in the theory of the case

Abstract

The general objective of the present research was to legally analyze the legal hermeneutics: Tool of interpretation of the factual elements in the theory of the case. The quantitative methodology was used, which produces descriptive data, originating from data collection. In addition, the inductive-deductive method was applied, which suggests that in order to find a truth, facts must be sought. The documentary-bibliographic analysis is considered as a way of technical research, a set of intellectual systematizations, generating an analytical-reflexive process, contributing to the generation of the extension of the state of the art. It is concluded that, with the legal analysis developed, it was determined that the legal hermeneutics has been poorly implemented, since it focuses on the textual interpretation of the norm, leaving isolated the interpretation of factual elements of the "Theory of the Case", which has had a significant impact on the procedural truth.
