Abuse of the right of protective action

The general objective of this research was to legally analyze the abuse of the right of protection action. It was supported by the quantitative methodology which produces descriptive data, originating from data collection. From the documentary-bibliographic support. In addition, the inductive-deductive method was applied, which suggests that in order to find the truth, facts must be sought and not based on mere speculation. The analytical-synthetic method was also used, by means of which a whole is broken down into parts. The use of these methods made it possible to analyze doctrines, normative bodies, legal documents, bibliography, which allowed the generation of criteria and contributions. It is concluded that most of the protection actions filed in the Judicial Unit based in the canton of El Carmen, during the year 2021, were declared unfounded for not having met the essential requirements established in the Law of Guarantees.
