Abstract

Objective: To analyze the psychological test as a legal mechanism to obtain pre-release in minor crimes. Method: A psychological test was carried out with people who have committed criminal acts with violence. Results and conclusions: The result that was obtained in front of the mentioned study, reflects that the participants who had a greater trait of psychopathy; In the prisons of Ecuador there is no organization or a speed that gives a clear faith legal security or effective protection, due process with that arises the need not to sacrifice rights established in the constitution for mere formalities. The functionality in the application of a test is a key point, but who would be in charge of carrying out a possible application would be the SNAI. A fundamental change could be added to the regulation in article 254, numeral 7, which would add the possibility of choosing PPL volunteer to undergo psychological test.
