The right to double compliance as a basic due process guarantee

The general objective of the research was to legally analyze the right to double compliance as a basic guarantee of due process. This research used the quantitative method, which produces descriptive data, originating from data collection. It was supported by the documentary-bibliographic review. In addition, the inductive-deductive method was used. The analytical-synthetic method was also used. A questionnaire was applied to the population of criminal judges of the Bolivar Province and lawyers in free professional practice, applied to a selective sample of 4 criminal judges and 100 trial lawyers. It is concluded that the right to double jeopardy must be clearly understood as a right recognized exclusively for the defendant who appeals or challenges the conviction issued for the first time by the court of appeal or cassation.
