Abstract

The general objective of the research was to legally analyze lynching and the functions of criminal law. The present research used the quantitative method which produces descriptive data, originating from data collection. In addition, the inductive-deductive method was applied, which suggests that in order to find a truth, facts should be sought and not be based on mere speculation. The analytical-synthetic method is also proposed. In addition, a survey was applied to 66 neighborhood representatives of the city of Guaranda. It is concluded that lynching is a morally accepted and legally reprehensible phenomenon, which not only occurs due to feelings of anger or indignation, but also due to the existence of triggering factors such as: distrust in the administration of justice, impunity for crimes, and an increase in delinquency.
