Conditional suspension of the sentence in the abbreviated procedure in the Ecuadorian procedural system

Abstract

The general objective of the research was to carry out a legal analysis of the conditional suspension of the sentence in the abbreviated procedure in the Ecuadorian procedural system. This research used the quantitative method, which produces descriptive data, originating from data collection. It was supported by a documentary-bibliographic review. The inductive-deductive method was also used. The analytical-synthetic method was also used. A survey was applied to a group of students studying for a Master's degree in Criminal Procedure Law and Oral Litigation. It is concluded that, according to the resolution of the National Court, there is no double benefit for those who request it, for the simple fact that there is no legality in the law, and that this legal vacuum would have to be repealed in order for there to be equality and this would help to reduce the number of abandoned court cases.
