Abstract

The general objective of the research was to legally analyze the violation of due process in the fines imposed in the inter-ministerial agreement 00002-2020. Ecuador. It was developed from the quantitative approach with a descriptive methodology with non-experimental design, which was supported by documentary-bibliographic analysis. This allowed the review of bibliographic material. In addition, a survey was applied to 145 lawyers of free professional practice, lawyers specialized in constitutional matters, judges specialized in Constitutional Law, who exercise their professional activity in the Canton Latacunga, province of Cotopaxi. It was concluded that any regulatory administrative act that regulates a specific sanctioning procedure must be subject to the legal precepts that regulate the matter, and must respect the constitutional principles related to due process, under penalty of suffering from defects that affect its validity and consequently may be declared null and void.
