Hydrocarbon offenses and the principle of proportionality in Ecuador

Abstract

The general objective of the research was to legally analyze discretionality in the application of the right to resistance and the Ecuadorian legal system. The qualitative approach was developed as a method, making use of several bibliographic sources in order to obtain real and updated information to achieve the objective set against the legal problem under analysis.  It was based on the analytical-synthetic approach, since with this it was possible to generate a superior knowledge since additional knowledge was added to previous concepts and the inductive method. For the collection of factual data on the problems studied, the interview technique was used in order to obtain relevant information. It is concluded that the principle of proportionality is that principle that has a constitutional rank, whose purpose is to protect the fundamental rights established in the Constitution, in order to avoid the disproportionate and disproportionate use of sanctions.
