Abstract

The general objective of the research was to legally analyze the presumption of innocence in relation to the exhibition of the apprehended person in the media. From the qualitative approach, several bibliographic sources were used in order to obtain real and updated information to achieve the objective set out in relation to the legal problem. The following methods were used: historical - logical since it helped to establish the relationships between the facts that take place in the development of science, analytical - synthetic since it was possible to generate a superior knowledge since additional knowledge was added. In addition, 3 judicial officials were interviewed. It is concluded that, despite the legislative advances in criminal matters in recent years, there are still norms that violate constitutional rights, such as article 529.1 of the Organic Integral Penal Code, where the principle of innocence is violated.
