Teoría del dominio funcional del hecho en delito de ciberplagio en el sistema penal ecuatoriano

El objetivo general del presente trabajo de investigación fue analizar jurídicamente la Teoría del dominio funcional del hecho en delito de ciberplagio en el sistema penal ecuatoriano. La presente investigación utilizó el método cuantitativo el cual produce datos descriptivos, que se originan por la recolección de datos. Apoyado en la revisión documental-bibliográfica. Además, se aplicó el método inductivo-deductivo. Se planteó además el método analítico-sintético. Se concluye que, el tratamiento del ciberplagio con herramientas de IA en el marco de la teoría del dominio funcional del hecho se debe realizar en el análisis factico y normativo del dominio de la acción, la voluntad y del hecho funcional determinando los grados de responsabilidad para las personas naturales y jurídicas. Es de carácter imperativo que el Estado ecuatoriano tome elementos de otros estados en materia de propiedad intelectual y de inteligencia artificial para el tratamiento de estas problemáticas.
