Abstract

The general objective of the research was to legally analyze detention for investigative purposes and its impact on the principle of presumption of innocence. The methodology was developed from the qualitative approach, using several bibliographic sources in order to obtain real and updated information to achieve the objective set against the legal problem under analysis, contrasting the information with the opinion of the jurists interviewed. In addition, bibliographic material, books, magazine articles, regulations and laws were analyzed, thus producing contributions to the law in the institution of due process in the guarantee of duty. It is concluded that article 530 of the Organic Integral Penal Code, which regulates detention for investigative purposes, is unconstitutional because it violates the principle of presumption of innocence, since detention is justified only in cases of a fair trial for the commission of a criminal offense
