Abstract

The general objective was to legally analyze the adoption of children and adolescents by same-sex marriages. The research was developed from the quantitative paradigm, it was also framed from a documentary-bibliographic design, through the inquiry, collection and critical documentary analysis and bibliographic reference, based on the methodical, rigorous and deep exploration of various documentary sources such as scientific research, articles, refereed works, laws, among others. Describing the findings found, allowing the development of the theoretical body in relation to the subject of study. It is concluded that adoption by homosexual couples does not affect the integral development of adopted children and that there is no accredited affectation of children living in a homosexual family, from this research it is indicated that "excluding the latter from the universe of potential adopters implies a limitation of the superior right of children and adolescents.
