Probative scope of medical audits in cases of health liability in administrative litigation

Abstract

The current regulations for the practice of MA are analyzed in the light of a judicial process in the city of Quito, where the following background is highlighted: At the Hospital de Especialidades Carlos Andrade Marín, the patient Inés Atahualpa Mejía, underwent surgery for a cesarean section after which she was left in a vegetative state and then died according to what was mentioned by the spouse. By means of information search through documentary review. In the Administrative Litigation, the reports issued after an investigation in AM, are considered as evidence under the provisions of the General Organic Code of Processes and such reports will be totally dependent on the knowledge and expertise of the Medical Auditor, despite these premises there are cases in which the reports made by the Medical Audit Committee have served for decision making in cases of health liability.
