Legitimate self-defense and its impact on the basic emotion of intense fear of the owner of the legal right

The general objective of the research was to legally analyze self-defense and its incidence on the basic emotion of intense fear of the owner of the legal property. The present research used the quantitative method which produces descriptive data, originating from data collection. It was supported by the documentary-bibliographic review. In addition, the inductive-deductive method was applied. The analytical-synthetic method was also used. It is concluded that, once the institution of self-defense is analyzed, it can be concluded that the element subsumed in the rational necessity of defense, presents a subjective requirement that must be analyzed from the psychological and physiological approach to determine that that aspect is contrary to the inherent responses of people.
