The proper application of mitigating factors in criminal contraventions in Ecuadorian legislation

Abstract

The general objective of the research was to legally analyze the due application of mitigating factors in criminal contraventions in Ecuadorian legislation. The quantitative method was used, which produces descriptive data, originating from data collection. Supported by the documentary-bibliographic review. In addition, the inductive-deductive method was used. The analytical-synthetic method was also used. A survey was applied to lawyers of the public defender's office (5), judges (4) and the Council of the Provincial Judiciary of Pastaza (3). It is concluded that the contravention processes in Pastaza during the year 2021 present nullity in terms of the application of mitigating factors for the reduction of the penalty. Judges are intransigent during the imposition of the sentence by not considering the mitigating factors foreseen in the COIP, and using as a basis that the contraventions have a special treatment and therefore there is no legal figure.
