Abstract

The general objective of the research was to legally analyze the joint and several liability for civil damages as a procedural subject in traffic offenses. The present research used the quantitative method which produces descriptive data, originating from data collection. Supported by the documentary-bibliographic review. Together, the inductive-deductive method was applied. The analytical-synthetic method was also proposed. It is concluded that, it is distinguished how the rights to effective judicial protection and the defense of the jointly and severally liable person in the processes for traffic offenses are violated, who are prevented by the Organic Integral Penal Code to waive their constitutional right to defend themselves in any process in an adequate manner, glimpsing that the penal norm is not in accordance with the Constitution of the Republic of Ecuador, by violating elementary rights of the basic guarantees of due process.
