Abstract

The general objective of the research was to legally analyze the lack of direct control of constitutionality by the judge in the abbreviated procedure. The present research work was developed from the quantitative approach with a descriptive methodology with a non-experimental design, which is supported by the documentary-bibliographic analysis. A research process was organized in which the study population was based primarily on written documents such as these, statistics and articles, and the analytical-synthetic aspect was based on mentally decomposing the subject studied into various elements. It is concluded that the lack of direct control of constitutionality by the judge in the application of the abbreviated procedure in the absence of an analysis of the mitigating circumstances for the imposition of the sentence has an impact on legal certainty, since the State is called upon to guarantee effective compliance and respect for the Constitution by the judge.
