Abstract

The general objective of the research was to make a legal analysis of the case study on the right to equality of pregnant mothers in Judgment 3-19-20-JP in Ecuador. The method used was based on the qualitative approach, handling the collection and analysis of a documentary-bibliographic typology. The research technique was the interview; the tool or instrument that supported it was the structured interview guide which was applied to legal professionals, specialized in the constitutional area, who gave informed consent to participate in this study. According to the analysis of sentence No. 3-19-20-JP of the Constitutional Court, it is concluded that there should be equal conditions for working pregnant mothers; all of them should be protected by the maternity leave regardless of the type of contract under which they provide their services. According to most of the interviews conducted, there IS an affectation of the right of pregnant mothers.
