Discretionality in the application of the right to resistance and the Ecuadorian legal system

Abstract

The general objective of the research was to legally analyze the discretionality in the application of the right to resistance and the Ecuadorian legal system. The research method used was the quantitative approach, through the exploration, collection and critical analysis through a documentary typology, supported by the bibliographic design that seeks reflection and analysis, building the method related to the phenomenon and thus evaluate or discuss new arguments. Documentary sources were examined and analyzed at a theoretical level, theses, and refereed works, laws and norms, related to the subject. The survey was applied to a sample of 60 lawyers registered in the Judiciary Council of the Province of Napo. It is concluded that the essence of the right to resistance lies in confronting the actions or omissions of the public powers of the State or of natural or legal persons not linked to it.
