Abstract

The general objective of this research was to analyze legally the historical and social evolution of the rights of indigenous peoples and nationalities in Ecuador. It is based on a quantitative, documentary-bibliographic perspective. This in view of the fact that from the documentary review and the study of the social reality observed, reflective conclusions have been inferred by the researcher, of the problematic raised. In this sense, the current regulations, theses, international agreements and refereed works related to the subject under study were analyzed. It is concluded that, it was evidenced that there is currently a certain violation towards indigenous peoples and nationalities when it comes to guaranteeing their innate or constitutionally established rights. This aspect marks a significant gap since the State, through the Constitution of the Republic of Ecuador, must guarantee the free ideology and promote the cultural recognition of indigenous peoples.
