Reckless malicious denunciation in domestic violence, and its impact on the guarantee system

The general objective of the research was to carry out a legal analysis of malicious misdemeanours in domestic violence and their impact on the legal system. The present research used the quantitative method which produces descriptive data, which originate from data collection. It was supported by a documentary-bibliographic review. The inductive-deductive method was also used. The analytical-synthetic method was also used. A survey was applied to four (4) judges belonging to the Domestic Violence Judicial Unit based in Santo Domingo. It is concluded that it is evident that there is a violation of the principle of innocence as stated in Article 76, paragraph 2 of the Constitution and Article 5, paragraph 4 of the Organic Integral Penal Code, and the right to a defence as ordered by the Constitution of the Republic, Article 77, paragraph 7, when the alleged victim denounces a violation of domestic violence.
