Abstract

The development of this research is focused on the determination of the responsibility incurred by the Ecuadorian State, as a consequence of the omission in the timely delivery of medical supplies to health centers, which may result in medical malpractice. Descriptive type through bibliographic documentary analysis. The results obtained show that the Ecuadorian positive legal system contains the constitutional and legal regulations that establish the responsibility of the State for the supply of medicines, supplies and health personnel necessary to comply with its duty to guarantee access to health for citizens. In this sense, the legislation is complemented with the actions and policies of the National Development Plan to achieve the constitutional mandate, establishing a priority budget for the provision of medicines in a timely manner.
