Discrimination and the judicial past. Study of the SATJE Computer System for Judicial Proceedings

This research work studied the relationship between the constitutional prohibition of discrimination with the concepts of judicial past and criminal record, which are freely accessible in the SATJE system of the Judiciary Council of Ecuador, within the framework of a constitutional state of rights. The methodology was descriptive with an analytical-synthetic method, as well as the techniques of bibliographic review. It was theoretically justified that the system of the Council of the Judiciary (SATJE), being open, can generate discrimination with respect to judicial past and criminal records. In addition to this, it is essential to reform it so that only the parties involved in a judicial process can access the information.
