Abstract

The right to the presumption of innocence requires that every person must be considered and treated as innocent until the contrary is declared in a final resolution or final conviction issued by a competent authority with all the guarantees of the right to due process and guardianship effective court. For the prevention of violence against women, administrative measures of immediate protection are imposed on the person identified as responsible, without the minimum guarantees of due process being respected in the procedure followed. The objective is to analyze the possible violation of the essential content of the right to the presumption of innocence when such measures are imposed. As a result, a series of recommendations are presented whose implementation will allow to better safeguard the right to the presumption of innocence that assists the person identified as responsible for violence against a woman.
