Lack of motivation of administrative acts in the Decentralized Autonomous Government in Ecuador

Abstract

This paper focuses on the administrative acts issued by the Autonomous Municipal Government of Azogues Canton, during the year 2020. It is verified here, to what extent the administrative acts comply with the essential requirement of motivating their acts, as a universal and constitutional guarantee of the right to defense. Thus, the pertinent parameters were established and relevant aspects of the motivation of administrative acts were analyzed from a historical, conceptual, dogmatic, constitutional, legal and jurisprudential point of view, as a theoretical framework and state of the art. The research used a scientific approach and a qualitative methodology (case by case), based on a sample of 75% of the administrative acts issued during the year in question. Finally, conclusions and recommendations were drawn for the municipal entity to optimize the motivation of its acts, considering that they could be useful for all public sector institutions.
