Analysis of competition for the conservation, administration and use of ports, airports, roads and national highways in the ordinationvenezuelan legal

Abstract

The Magna Carta in order to regulate the coparticipation of the Powers in order to
achieve their ultimate goal, which is the common benefit of citizens, establishes the
different powers assigned to each power, whether national, state and municipal, taking
into account the restrictive principle of competition. In this sense, the basic intention of the study is to analyze the Competition in relation to the conservation, administration,
use of ports, airports, roads and highways, established in the legal system, specifically
in ordinal 10 of Article 164 of the Constitution of the Bolivarian Republic of Venezuela
(1999). To that end, an investigation was conducted. It was concluded that the reform of
the aforementioned law is Constitutional while the Constitutional Chamber does not
consider the contrary, so the law is efficient and effective, although it violates the
Constitutional principles, because the powers granted to the Executive power are very
broad.
