Insurmountable fear as a justifying cause of unlawfulness

The general objective of the research was to legally analyze insurmountable fear as a justifying cause of unlawfulness. The present research used the quantitative method, which produces descriptive data, originating from data collection. It was supported by the documentary-bibliographic review. In addition, the inductive-deductive method was applied. The analytical-synthetic method was also used. It is concluded that the exoneration of insurmountable fear has been widely recognized and studied by the criminal doctrine, however, there has been no consensus regarding its regularization and application, this, because some theories have considered it as a cause of justification, others as a cause of unimputability, and some as a cause of exclusion of guilt.
