Effective cooperation agreements in the light of the principles of timeliness and proportionality in criminal matters

The general objective of the research was to legally analyze the effective cooperation agreement in view of the principles of opportunity and proportionality in criminal matters. The method used in the research was based on the qualitative approach, handling the collection and analysis of a documentary-bibliographic typology. The research technique applied was the interview, which was applied to five lawyers with academic training in criminal law and more than two years of experience in the exercise of their functions. An analytical-reflexive process was generated. It is concluded that there are not enough doctrinal or legal foundations with which a judge can duly motivate the acceptance of an Effective Cooperation Agreement and his or her broad discretion to interpret the qualifiers established in the norm to validate "the effectiveness of the information" provided by the defendant, may jeopardize the success of the investigation and also the freedom of a person.
