Abstract

The general objective of the research was to carry out a legal analysis of the victim's challenge to the principle of non reformatio in pejus: Ecuadorian criminal procedure. This research used the quantitative method, which produces descriptive data, originating from data collection. Supported by a documentary-bibliographic review. The inductive-deductive method was also applied. The analytical-synthetic method was also used. It is concluded that, the right of challenge or the right to appeal allows the merits of a decision to be re-examined through an assessment of the factual issues and the application of the judgment to those facts. Therefore, an appeal or cassation should be available unless there are factors that would make it inappropriate. The value of an appeal must be balanced in the particular circumstances.
