The general objective of the research was to legally analyze the application of oral litigation strategies and techniques in case theory. The present research used the quantitative method which produces descriptive data, originating from data collection. Supported by the documentary-bibliographic review. Together, the inductive-deductive method was applied. The analytical-synthetic method was also proposed. It is concluded that it is necessary for the lawyer dedicated to criminal matters, whether as prosecutor or defense attorney, not only to know about criminal law and its theories, but also about the criminal process, evidence, oratory for litigation and negotiation, as well as to be informed about the current and legal language, also the technical language, and to cultivate its presence, since there is no doubt that it is a set of factual, legal and evidentiary elements that are combined with visual and auditory aspects.
