Infringement of due process in prior administrative summary actions against teachers

Abstract

The general objective was to legally analyze the violation of due process in previous administrative summary actions against teachers. The approach taken by the researchers for the development of the method was based on the quantitative approach, through the inquiry, collection and critical analysis of documents and bibliographic references, based on the methodical, rigorous and deep exploration of various documentary sources consisting of articles, rules and laws among others, describing the findings. In the research, documentary review was used as a technique. It is concluded that, by not establishing the participation of the administered during the previous actions of the administrative summary against the teachers of the Ministry of Education, the due process is violated in the guarantee that no one can be deprived of the right to defense at any stage or level of the process, as well as the principle of constitutional supremacy is not respected.
