Victim participation in the trial hearing

The objective is to analyze the possible violation of the right of the victims contemplated in article 11 numeral 1 of the Organic Integral Penal Code by establishing that a private or public technical defense team acts in the trial hearing without their will in the canton Cuenca Province of Azuay between the months of March and July 2021. Descriptive. 62.5% of the victims are men, while 34.4% are women. In order to cease the violation of rights in the trial hearing, a consultation should be sent to the two highest bodies of interpretation such as the Constitutional Court and the National Court of Justice so that they can rule on the interpretation of the rule made by the Specialized Chamber of Military Criminal, Police Criminal and Traffic of the Provincial Court of Justice of Azuay within the case 01282-2018- 01573.
