Right to defense in the Public Defender´s Office. Case: of the Criminal Court of Cuenca, first semester 2020

This article seeks to find a relationship on the Right to defense, and the actions of Public Defense; establishing that the Right to Defense is a basic guarantee that is part of the Constitutionality block that is reflected in the Constitution and therefore in the Código Orgánico Integral Penal, as well as in international treaties. Based on the perception of the users or the public defender´s office in processes that are part of the sample, it was possible to show that the actions of the public defenders who participated in said processes, either as technical defenders of the accused or victims, were not optimal since there is no necessary link with the users, the user was not informed about how the defense was going to be, the facts were not investigated in the user so that, in this way, they could obtain evidence that would benefit their legal situation or of the rights that he claimed as a victim of a process, thus determining shortcomings that could occur in said actions that denote a violation of the Right to Defense in people. Likewise, analogous correlation studies are carried out to compare the results obtained by the author against other national and international results and with them show the deficiencies noted.
