Abstract

The general objective of the research was to legally analyze the violation of the guarantee of non-self-incrimination in resolution 327-2014 CNJ in Ecuador. It was developed from the quantitative perspective, descriptive type is complemented by a documentary-bibliographic design, allowed the collection of information extracted from the different legal texts approaching the analytical method, examined in the analysis of written content, through the development of documentary memos, consisting of the constitution, rules, laws and research articles. Likewise, a questionnaire of five questions was applied to a group of 252 lawyers. It is concluded that, having analyzed self-incrimination as a volatile legal element, it can be used to harm one of the parties. The traffic offenses and at the moment of agreeing to a conciliation it should be proposed when the guilt is determined on the basis of evidence, it can be agreed to a conciliation.
